The Supreme Court of Nigeria has upheld Senator Ademola Adeleke as the authentic candidate of the People’s Democratic Party in the July governorship election in Osun state.
The court made the decision today after hearing the from both parties to the suit.
Prince Dotun Babayemi had dragged the Governor-Elect to the court, asking to be recognized as the candidate of the party.
Babayemi emerged from a factional primary held on March 8 at WOCDIF event center.
The panel of the court dismissed the appeal today for being filed out of stipulated time.
Counsel to the Appellant, Mr. Adebayo Adelodun, (SAN), decided to withdraw the appeal when the panel led by Justice Amina Augie, drew his attention to the fact that the case was outside the 14 pays period provided by the law.
The judges said that the appeal was statute barred, and incompetent.
