The People’s Democratic Party (PDP) and its Presidential Candidate, Atiku Abubakar’s application to bring in new evidence, has been thrown out by the Supreme Court of Nigeria.
Justice Okoro delivering the lead judgment at the Supreme Court held that the Apex Court lacked jurisdiction to admit fresh evidence.
The court ruled that there was no issue for determination by the appellant.
He ruled that almost over a year after the certificate was submitted, the appellant did not make any efforts to obtain the evidence they were attempting to bring before the court until after the verdict of the tribunal.
The Supreme Court also agreed with the Presidential Election Tribunal on
the issue of 25 percent votes in Abuja.
Justice Okoro ruled that it was not the intention of the drafters of the constitution to deprive somebody who has secured the 25 percent of votes as stipulated by the constitution to be deprived because he failed to secure 25 percent in Abuja.
