The legislative and Judiciary arms of government in Oyo state may clash over the impeachment process of embattled Deputy Governor, Engr. Rauf Olaniyan
The State High Court on Wednesday adjourned for ruling till July 26, a suit filed by Engr. Olaniyan challenging his planned impeachment by the House of Assembly.
The suit which has as defendants, the House of Assembly, the Speaker and the Clerk of the House came up for hearing where the Court order maintenance of status quo pending the determination of the substantive suit.
However, while the case was going on, it was reliably gathered that the House at the plenary session has instructed the Chief Judge to set up Committee that will investigate various allegations leveled against the Deputy Governor.
The Court, on wednesday, after hearing from the both sides adjourned the case for ruling on July 26, 2022
It will be recalled that when the case came up for hearing on Monday before it was later adjourned till Wednesday, the Court ruled that the status quo should remain pending the determination of substantive suit.
Justice Ladiran Akintola of the Oyo State High Court, Ibadan has fixed July 26 for delivering judgement on the matter brought before it by Deputy Governor Rauf Olaniyan.
The court fixed the date after hearing counsels involved on the originating summons and interlocutory injunctions on the propriety of an impeachment proceedings embarked upon by the members of the Oyo State House of Assembly.
The Speaker, Oyo State House of Assembly, Deputy Speakers Oyo State House of Assembly and the Clerk, Oyo State House of Assembly are the first, second and third defendants in the matter respectively.
While Chief Afolabi Fashanu, SAN appeared for Olaniyan (claimant), Otunba Kunle Kalejaiye, SAN led the legal team of the defendants.
The court also on Wednesday rejected an application by the lawmaker representing Oorelope constituency, Lateef Adebunmi who sort the consent of the court to be joined in the suit as the fourth co-defendant in the matter.
Also, the court earlier rejected the application for adjournment of the matter by the claimants counsel, Chief Fashanu on the ground that, the House of Assembly in obvious disregard to subsisting status quo order had directed the state Chief Judge, Justice Muntar Abimbola to set up a investigative panel for Olaniyan.
