COURT DISMISSES DSS SUIT SEEKING TO KEEP EMEFIELE IN DETENTION

 The Federal Capital Territory High Court in Abuja, presided over by Justice Hamza Muazu, on Thursday, dismissed a request filed by the Department of State Services (DSS) seeking a 14-day extended detention order for the suspended Central Bank Governor, Mr. Godwin Emefiele.

The DSS in its new application told the court that the Service had new evidence it had discovered against the embattled ex-CBN boss.

The DSS application was filed discreetly by its legal team on Wednesday, evening and came before the vacation judge on Thursday.

But Justice Muazu dismissed the application, describing it as an abuse of court process adding that it lacked jurisdiction to entertain the matter.

When the DSS’s counsel, Mr. Victor Ejelonu, was queried by the judge about the court’s jurisdiction, considering the exclusive rights of the Magistrate Court to grant detention orders under Sections 293 and 296 of the Administration of Criminal Justice Act, Mr. Ejelonu, opted to withdraw the matter.

The development came after Mr. Emefiele was re-arrested by the DSS from the Federal High Court premises in Lagos, sequel to his remand in a Correctional Centre, while awaiting the fulfilment of his bail conditions granted by Justice Nicholas Oweibo.
