The Court of Appeal sitting in Abuja on Thursday overturned the decision of the Nasarawa State Governorship Election Petition Tribunal on Oct. 2 which nullified the election of the All Progressives Congress (APC) Gov. Abdullahi Sule.
The three-judge panel of the court ruled that the tribunal erred in declining to rule on the legal issues raised in the APC and Sule’s objection, which challenged the tribunal’s jurisdiction to hear the petition by the Peoples Democratic Party (PDP) and its candidate, David Ombugadu, as well as the petition’s competence.
The court held that the petitioners at the tribunal – PDP and Ombugadu – failed to prove their allegations of over-voting and non-compliance with the Electoral Act.
