Appeal Court Sacks Elumelu, Declares LP’s Okolie Winner

News Investigators/ The Court of Appeal sitting on Thursday in Abuja sacked the member representing Aniocha/ Oshimili federal constituency in the House of Representatives, Ndudi Elumelu.

The court, in two judgments, declared Ngozi Okolie of the Labour Party (LP) as winner of the election.

The appellate court set aside the judgment of the National and State Houses of Assembly Election Petition Tribunal in Asaba which earlier declared Mr. Elumelu as winner.

Mr. Elumelu who was the candidate of the Peoples Democratic Party (PDP) in the last February, 25 2023 election had earlier been sworn in to represent Aniocha/Oshimili Federal Constituency of Delta State for the fifth terms.

However, the Appeal Court faulted the tribunal for voiding Okolie’s election and dismissed the petition filed by Elumelu before the trial tribunal on which the voided judgment was given.

The court agreed with the lawyer to the Labour Party, Mahmud Magaji, that Okolie was duly nominated, sponsored by his party contrary to the position of the Tribunal.

Mr. Mahmud had argued that his client was duly nominated and sponsored by LP, adding that he resigned his appointment as a Senior Special Assistant (SSA) to Delta State Government as required by the constitution.
