A Federal High Court in Abuja on Monday granted leave to the Peoples Democratic Party (PDP) to file a motion for an Order of Mandamus to compelling Speaker Aminu Tambuwal to declare the speaker’s seat vacant in the House of Representatives.

In an ex parte application brought by Mr. Mike Ahamba (SAN), counsel to PDP, the party urged the court to compel Speaker Tambuwal “to give effect to the provisions of Section 68(1) (g) of the 1999 Constitution by declaring the Kebbe/Tambuwal Federal Constituency seat vacant.”

Justice Ahmed Mohammed also granted leave for the party to serve the originating summons of the application to principal officers of the House by delivering it on the Clerk of the House of Representatives.

The court dismissed an application by two of Tambuwal’s constituents of Kebbe/Tambuwal Federal Constituency of Sokoto State seeking to join suit to stop the moves to remove Speaker as lacking in merit.
