This followed the application filed by the prosecutor seeking the inclusion of missing documents from the proof of evidence list.

The private prosecutor, Sanya Akinyele, said having gone through the file, he discovered that two vital documents were missing from the proof of evidence list.

Akinyele identified the documents as the medical report of the test carried out on Lowo and the statement of co-tenant of the defendant.

He said these were necessary for justice to prevail.

Reacting, the defence counsel, Abioye Ashanke, said he had the statutory rights to study the application before reacting and thus requested for the adjournment.
Ashanke said the charge against his client attracts capital punishment and as such he needed to take his time.

The Chief Judge of Oyo State, who is presiding over the matter, Justice Muktar Abimbola, described the application as formal and granted the adjournment.
